Long-term disposal security for Upper Austria: SAXINGER accompanies successful procurement procedure

SAXINGER provides legal support to the bidding consortium consisting of Energie AG Oberösterreich Umwelt Service GmbH and Linz Service GmbH für Infrastruktur und Kommunale Dienste in the Europe-wide procurement procedure, ensuring a successful contract award through 2036.

The thermal processing of residual and bulky waste in Upper Austria is secured for another ten years, until 2036. BAV Abfallbehandlungs GmbH (BAVA) has once again awarded the contract to a consortium of Energie AG Oberösterreich Umwelt Service GmbH and Linz Service GmbH.

The new contract will take effect on July 1, 2026, ensuring the annual processing of around 160,000 tons of residual and bulky waste. This guarantees environmentally sound and reliable waste management for municipalities in Upper Austria over the long term.

SAXINGER provided legal support for the bidders throughout the procedure. The lead partners Edwin Scharf, Franz Mittendorfer, Thomas Rosenthaler, and attorney-at-law Dieter Duursma contributed their expertise in public procurement and public commercial law to structure and implement the complex project.

The contract covers the thermal recovery of non-recyclable waste at the Linz and Wels facilities, where it is converted into district heating and electricity for tens of thousands of households. By efficiently using waste as an energy source, around four billion cubic meters of natural gas are saved each year – a significant step toward a circular economy and climate protection.
