Certification
Certification is the confirmation by a notary or court official of the authenticity of a signature, document or translation. If a document is to be registered on the basis of a private document (e.g. a contract of sale), the prerequisite for registration is that this document has been certified by a court or a notary, and that, in the case of natural persons, the certification note also includes the date of birth.
The requirement for certification does not apply if the private document is accompanied by a statement of approval from a public authority which appears to be authorised to safeguard the interests of the person whose rights are to be restricted, encumbered, revoked or transferred. Foreign documents are subject to the additional requirement of ‘super-legalisation’. This means that they require additional legalisation by an Austrian diplomatic or consular mission of the foreign state. Legalisation may be waived on the basis of bilateral agreements (legalisation treaties; e.g. with Germany, Spain, Switzerland).
