Consumer Protection Act

The Consumer Protection Act, which first came into force in 1979, aims, as its name suggests, to protect consumers in transactions with traders, as consumers are usually at an economic disadvantage in such relationships or may lack legal knowledge. If a contract deviates from the mandatory provisions of the Consumer Protection Act to the detriment of the consumer, such a contract is void.

Key provisions of the Consumer Protection Act (KSchG) include, in particular, the consumer’s right to withdraw from so-called doorstep sales and where relevant circumstances do not apply; but the provisions concerning unfair contract terms in consumer transactions and those relating to distance selling are also of great practical importance.
