Action for the restoration of ownership

An action for the restoration of ownership enables the owner in possession of an item to defend against interference by third parties who are unlawfully encroaching upon their right of ownership. In doing so, the claimant must prove both their right of ownership and the defendant’s infringement. The action for protection of property rights is aimed at restoring the previous state of affairs and, in the event of an immediate threat or where there is a risk of repetition, at securing an injunction against future interference.
