Decree

What is a decree?

‘Decrees’ are the term used to describe statements issued by the Federal Ministry of Finance (BMF) in which it sets out its legal opinion on specific laws, regulations or individual issues. They therefore constitute an interpretation of the legal position by the BMF. Their primary purpose is to ensure the uniform application of tax laws by the tax authorities. Circulars are not binding and do not give rise to any subjective rights. Consequently, the authorities and courts responsible for interpreting tax law are not bound by circulars.
